FTC Scrutiny of Telehealth Weight-Loss Marketing Claims

The Federal Trade Commission has authority over deceptive advertising, and telehealth weight-loss marketing has drawn increasing attention under that authority.

The FTC enforces federal law against unfair or deceptive advertising practices, which extends to health and weight-loss product marketing, including claims made by telehealth platforms about GLP-1 drug access, results, and pricing.

What draws FTC attention

Common areas of scrutiny include unsubstantiated results claims, unclear disclosure of subscription pricing or auto-renewal terms, and marketing that blurs the line between an FDA-approved product and a compounded alternative.

This is separate from FDA drug regulation

FTC authority covers advertising and marketing conduct; it doesn't replace FDA oversight of the drug product itself. A company can face FTC action over marketing claims independent of any FDA action on the underlying product.
