State Drug Importation Programs: How They Actually Work

Federal law includes a provision allowing states to submit importation program proposals to the FDA for approval, aimed at safely importing certain prescription drugs from Canada at lower cost, subject to FDA safety review and sign-off.
Not automatic or unconditional
A state submitting a proposal doesn't guarantee FDA approval, and approved programs are subject to specific drug-eligibility rules, safety testing requirements, and Canadian regulatory cooperation — meaning implementation has generally moved slower than initial legislative announcements suggested.
Distinct from personal importation
These are pharmacy or wholesaler-level bulk importation programs operating under specific federal authorization, a different legal pathway from an individual attempting to personally import medication, which remains generally restricted.
